SC asks UP govt to withdraw recovery notices against anti-CAA protesters

New Delhi [India](ANI): The Supreme Court has asked the Uttar Pradesh government to withdraw the recovery notices issued to the alleged anti-CAA protesters in December 2019 while observing that the proceedings were contrary to the law laid down by it.

A bench of Justices DY Chandrachud and Surya Kant gave the final opportunity to the State to withdraw the recovery notices saying otherwise it will quash the proceedings for being in violation of the law.
“Withdraw the proceedings or we will quash it for being in violation of the law laid down by this court,” the bench told the counsel appearing for the Uttar Pradesh government.

During the hearing, the bench observed that the Uttar Pradesh government has acted like a “complainant, adjudicator and prosecutor” by itself in conducting the proceedings to attach the properties of the accused.

The apex court was hearing a plea seeking quashing of the recovery notices issued by the Uttar Pradesh administration to recover the damage caused to public properties in connection with protests against the Citizenship (Amendment) Act in the state.

The petition was filed by advocate Parvez Arif Titu who sought direction for setting up an independent judicial enquiry to probe into the incidents that occurred during the protests against the CAA-NRC in Uttar Pradesh.

Appearing for Uttar Pradesh, Additional Advocate General Garima Prashad apprised the top court that 106 FIRs were registered against 833 rioters in the State and 274 recovery notices were issued against them.

She added that out of the 274 notices, recovery orders were passed in 236 while 38 cases were closed. Prashad had also revealed that these orders were passed by Additional District Magistrates. She also said that under the new law notified in 2020, claim tribunals have been constituted which is being headed by retired district judges, and earlier it was headed by Additional District Magistrates (ADMs).

To this, the bench said that the Supreme Court has passed two judgements in 2009 and 2018, which said that judicial officers should be appointed in claim tribunals but instead State appointed ADMs.

Earlier, the Uttar Pradesh government had told the apex court that property damage claims tribunals have been set up to adjudicate the claims of private individuals and government authorities for compensation for the destruction of property during anti-CAA protests and riots in the state.

The tribunals were constituted under the Uttar Pradesh Recovery of Damage to Public and Private Property Law, 2020.

Last year, the apex court had asked the State government not to take action on earlier notices sent to the alleged protestors by the district administration for recovering losses caused by damage to public property during the anti-CAA agitations in the state.

The plea stated that the Uttar Pradesh government has appointed an additional district magistrate to deal with the process of notices for recovering damages for loss of public property during protests against the CAA whereas the guidelines laid down by the top court stipulated that retired judges should deal with the matter.

The petition further submitted that notices have been sent in Uttar Pradesh in an “arbitrary manner” against a person, who had died six years ago at the age of 94. The notices were issued to two others who are aged above 90, the plea claimed.

Seeking a stay on notices, the petition stated that notices have been sent to persons who have not been booked under any penal provisions and no details of FIR or any criminal offences have been made out against them.

It was contended that recovery notices were based on an Allahabad High Court judgement passed in 2010 which is in “violation of the guidelines” passed by the Supreme Court in a 2009 judgment which was later re-affirmed in a 2018 verdict.

The plea, filed through advocate Nilofar Khan, stated, “The contradiction is that while the Supreme Court in 2009 put the onus of assessment of damages and recovery from the accused on High Courts of every state, whereas the Allahabad High Court had issued guidelines in 2010 judgement that let the state government to undertake these processes to recover damages, which has serious implications”.

The petition also sought direction from the Uttar Pradesh government to follow the procedure as per the 2009 and 2018 guidelines of the top court while claiming damages to recover the losses caused to public property during such protests.

925 persons, who have been arrested so far in connection with the violent protests, may not get bail easily in Uttar Pradesh till they pay up for the losses as they have to be given conditional bail only after they deposit the amount, the petitioner had added. (ANI)(instagram Image)

Priyanka Gandhi’s plans for women in UP

New Delhi [India] : Ahead of the Uttar Pradesh assembly polls, women top the agenda for Congress general secretary Priyanka Gandhi.
After the announcement of giving 40 per cent tickets to women, Priyanka Gandhi has made several promises to cater to half of the population i.e. women voters. Congress is preparing in a big way to fulfil Priyanka Gandhi’s agenda for women in UP.
Acting on the agenda, Priyanka Gandhi will be holding a town hall with women in Lucknow on November 13.
According to sources, over 7,500 women workers are being trained as the “Ladki Hoon Brigade”. At the time of announcing 40 per cent of tickets to women, Priyanka Gandhi had given the slogan “Ladki Hun Lad Sakti hun”.
Congress is planning to reach five crore women regarding the announcements made for them.
Congress is also preparing a separate manifesto for women, major points of which Priyanka Gandhi has already announced.
Other than giving 40 per cent tickets to women, Priyanka Gandhi has also promised that if the Congress government is formed in Uttar Pradesh, women will be given three LPG cylinders free of cost annually.
She has also promised that women will be given the facility of free travel in government buses of the state, and the girl students there would be given a smartphone and scooty.
Other major points announced in the manifesto include an honorarium of Rs 10,000 per month to ASHA and Anganwadi workers, the appointment of women to 40 per cent posts according to the provisions of reservation, offering pension of Rs 1,000 to old widows, and opening of 75 skill schools across Uttar Pradesh which will be named after brave women of Uttar Pradesh.
On these promises, the Congress is going to run a public relations campaign on a large scale among women.
Apart from focusing on women, Congress is also going to organise 100 town halls after the Congress Pratigya Yatra to make announcements like two million government jobs and loan waiver of farmers to the common people.
In these town halls, various sections and issues of the society will be discussed.
Congress has been waiting for three decades to return to power in UP. This time the party has thrown full force to achieve it.
In-charge Priyanka Gandhi is leading in an aggressive manner on every front.
The Congress, which has lost its support base and caste equation in the last elections, is relying on Priyanka’s face and the power of women voters.
If you look at Priyanka Gandhi’s UP tours so far, her direct connection with women is visible. That is why Congress feels that women can be influenced by rising above the caste barriers and the party, which is marginalized in the state, can get electoral life.

Jinnah and Gandhi compared

Condemning the statement, BJP spokesperson Rakesh Tripathi said, “The country considers Muhammad Ali Jinnah as the villain of the partition. Calling Jinnah the hero of freedom is the politics of Muslim appeasement.”

Lucknow (UP): Samajwadi Party chief Akhilesh Yadav on Sunday, comparing Sardar Patel, Mahatma Gandhi, Jawaharlal Nehru and (Muhammad Ali) Jinnah said that they all were from the same institute, and fought for India’s freedom. “Sardar Patel, Mahatma Gandhi, Jawaharlal Nehru, and (Muhammad Ali) Jinnah studied in the same institute,” the former UP Chief Minister said, “they became barristers and fought for India’s freedom.”

Adding further, Yadav said that “It was Iron Man Sardar Vallabhbhai Patel who imposed a ban on an ideology,” referring to the RSS and ruling party BJP. Condemning the statement, BJP spokesperson Rakesh Tripathi said, “The country considers Muhammad Ali Jinnah as the villain of the partition. Calling Jinnah the hero of freedom is the politics of Muslim appeasement.”

Yadav lavished praise on Patel on his 146th birth anniversary but raised eyebrows at one point when he appeared to equate the four leaders, including Jinnah, the founder of Pakistan.

Addressing a public meeting in Hardoi, the SP leader said, “Sardar Patel understood the ground and he made decisions accordingly. Hence, he is also known as the Iron Man.

“Sardar Patel, Father of the Nation Mahatma Gandhi, Jawaharlal Nehru and (Muhammad Ali) Jinnah studied in the same institute and became barristers. They helped (India) get freedom and never backed away from any struggle.”

Yadav also referred to the ban imposed on the RSS by Patel, the then home minister, following the assassination of Gandhi in 1948, saying only he could do it. He said Patel fought for farmers and hence, is known as ‘Sardar’.

“The BJP is remembering the Iron Man of India, Sardar Vallabhai Patel, today. But if it walks on the path shown by Sardar Patel, then the three farm laws, which it has enacted, should be withdrawn. This will be a true tribute to Patel,” he added.

“The BJP claims that it is walking on the path shown by Sardar Patel, but today farmers are the saddest,” Yadav said.

Farmers’ income has dipped, there is price rise and the way this government is functioning, every section of society is feeling insulted, he alleged.

On the Uttar Pradesh Assembly polls, Yadav claimed that all sections of people in the state have made up their minds to elect an SP government in the 2022 elections. After the SP comes to power, Uttar Pradesh will get back on the path to growth and prosperity.

Taking a dig at the ruling BJP, he said that the party has only one thing to do — renaming projects completed by the previous SP government.

“The BJP is inaugurating all projects undertaken by the Samajwadi Party. ‘Baba mukhyamantri’ is an amazing chief minister who has not inaugurated any work done by his government,” Yadav said, referring to Chief Minister Yogi Adityanath.

‘BJP failed to fulfil promises ‘

Lucknow (Uttar Pradesh) [India], October 30 (ANI): Ahead of the 2022 Assembly elections in Uttar Pradesh, Samajwadi Party chief Akhilesh Yadav on Saturday accused the BJP-led state government of failing to fulfil the promises they had made to the farmers in their election manifesto.
“It seems that BJP made its manifesto and threw it in the trash because they never turned through its pages. They forgot their own manifesto. They had promised that by 2022, the income of farmers will be doubled and a roadmap will be prepared for that. Today the farmer in Uttar Pradesh wants to ask, till when their incomes will be doubled?,” said Akhilesh. Yadav also alleged that the Yogi Adityanath-led BJP government in the state has failed to make timely payments to the Sugarcane farmers as they had promised in their manifesto.
Raising the issue of paddy procurement on Minimum Support Price (MSP), he said, “Farmer was assured that paddy will be procured on MSP. Today, paddy is ready. But the government has failed to provide the MSP to the farmers. Moreover, they have also failed those farmers who suffered losses due to heavy rains by not giving them any compensation for that.”
Yadav alleged that the government stopped making new Mandis and closed down the existing ones.
“They talked about improving the agriculture infrastructure. Farmers now want to know how much the Mandis has improved and how many good works and decisions have been made for the improvement of agriculture infrastructure,” he added.
He also alleged that BJP had betrayed the people in Bundelkhand, a region that he said that ‘put its trust in BJP’.
“Bundelkhand is still lying dry, a drought-like situation is there,” he added.
Taking further shots at BJP, he questioned them that what it had done with the 20 thousand crore rupees it had planned to use for setting up an irrigation fund.
Pointing out government’s failures in dairy industry, he added, “Samajwadi Party set up plants of 5 lakh litres per day in Lucknow and Bhognipur. A lot of money was given to improve existing plants in the budget. But today in Amul plants, milk from Gujarat is used, not that of our own farmers in UP.”
He asserted that his party will form the government after 2022 assembly polls.
“The slogan of Yogi ji will go from ‘Mera Pariwaar, Bhaajpa Pariwaar’ to ‘Mera Pariwaar, Bhaagta (running) Pariwaar,” he remarked.
Uttar Pradesh Assembly elections are scheduled to take place early next year.

“Ensure Yogi in 2022”

Underling the importance of Uttar Pradesh in national politics, Union Home Minister Amit Shah on Friday called on the electorate in the state that if they wanted to see Narendra Modi as Prime Minister again in 2024, then they have to ensure that Yogi Adityanath is elected as the Chief Minister again in 2022.

Lucknow (Uttar Pradesh) [India] : While addressing the launch of ‘Mera Parivaar-BJP Parivaar’ membership drive, Shah said, “If you want to make Modi PM again in 2024, make Yogi the CM again in 2022. We will make UP the number one state. Without UP there cannot be a government at the Centre and the credit of the Narendra Modi governments in 2014 and 2019 goes completely to people of Uttar Pradesh.” The Union Home Minister said that the BJP government had fulfilled 90 per cent of promises made in the 2017 manifesto and the remaining 10 per cent would also be completed by Chief Minister Yogi Adityanath in the next two months.
“Today I can proudly say that Yogi ji and his team have fulfilled 90 per cent of the promises that we made in our 2017 manifesto. I want to say to Yogi ji to march towards 100 per cent target in upcoming months so that people can believe that BJP fulfils whatever it says,” said the home minister.
Shah further expressed confidence that the BJP would cross the mark of 300 seats in 2022 and Adityanath would return to power.

Speaking about Ayodhya’s Ram Janmbhoomi Temple, Shah pointed out, “Did anyone even imagine there will be a Ram Mandir in Ayodhya and reminded Samajwadi leader Akhilesh Yadav of his jibe, ‘Mandir wahin baneyenge, tithi nahi batayenge’.”
Further slamming the Opposition parties, he said that for many years the Samajwadi Party (SP) and Bahujan Samaj Party (BSP) game happened which resulted in the destruction of Uttar Pradesh. “Seeing the law and order situation of UP, my blood used to boil. From west UP people were migrating. But now, no one can dare to make anyone migrate. Today, there are no Bahubalis. This change is because of the BJP government,” he said.
He further said that unlike the opposition we have proved that Bharatiya Janata Party governments work for the poorest of the poor.
Uttar Pradesh is set to go to the polls next year.

Why 40 pc tickets for women? : BSP

Bahujan Samaj Party (BSP) on Wednesday termed Congress’ announcement of 40 per cent reservation for women in forthcoming assembly polls as an election gimmick and asked why the scheme was not announced in other election-bound states.

New Delhi [India] : BSP spokesperson Sudhindra Bhadoria said that the Congress party has a long history of deceit. “They have announced 40 per cent seats for women in Uttar Pradesh with an eye on the upcoming Assembly elections. I want to ask Priyanka Ji, who is a woman herself and also the national general secretary of the party, that Assembly elections are being held in five states. Women do not reside in other states? Haven’t women already lived in other states? Then why such announcements are being made only for Uttar Pradesh?” asked the BSP leader.
Bhadoria further hit out on the Congress party and alleged that the party has always been doing “election drama” (election gimmick).
“I remember when Baba Saheb brought the Hindu Code Bill for the rights of women. It was the Congress party that opposed the bill that was going to empower women,” he said.
Bhadoria further alleged that the reservation bill for women was never passed by Congress during its tenure at the Centre.
“Women’s reservation bill was never passed by the Congress government despite so many years in power. Not only this, Congress always used to play a kind of trick with the Dalits. On one hand, Charanjit Singh Channi has been made the Chief Minister and on the other hand, he is humiliated by Sidhu. It means to say that in the Congress party whether there are women, Dalits and backward, they have never given any rights,” he said.
Priyanka Gandhi Vadra on Tuesday said that if any women want to bring a change in society by contesting an election, she can join the Congress, and women’s strength and sympathy can bring a revolution.
“The Congress party has decided that it will give 40 per cent of the total election tickets to women in upcoming assembly polls in the state. These tickets will be given on the basis of merit and not just on the basis of caste or religion,” Vadra had said.

The Communist Party of India (CPI) on Thursday said the single-member commission of enquiry set up by the Uttar Pradesh government for the Lakhimpur Kheri incident which claimed eight lives was an ‘eyewash’, otherwise why would the Supreme Court have to take cognisance of it.
While speaking to ANI, CPI’s General Secretary D Raja said, “The state government committee is an eyewash to hoodwink the people. Why would the Supreme Court have to take cognisance then? Let us wait and see what the SC orders.” A single-member Commission of Enquiry, headed by retired High Court Judge Pradeep Kumar Srivastava, with headquarters at Lakhimpur Kheri, was constituted today to investigate the death of 8 persons in Lakhimpur Kheri on October 3.

“Neither has he uttered a word nor has he dismissed the minister. The CM also seems to have lost all moral responsibility. The SC’s decision sends the main message,” he added.
Condemning the incident, Raja said, “What happened in Lakhimpur is horrific. Sharad Pawar compared the incident with Jallianwala Bagh. It is worse than Jallianwala Bagh because that is what happened during the British rule and this has happened in an independent nation, a democratic country. Where is the rule of law?”

Siberian birds flock to Sangam, attract tourists

Even though winter is yet to arrive in the country, thousands of Siberian birds have flocked to Sangam and nearby wetlands in Uttar Pradesh’s Prayagraj.
The migratory birds are a major attraction for tourists at Sangam, which is also known as the king of pilgrimages. The arrival of these annual visitors at various water bodies heralds the onset of winter. Various species of birds fly from Siberia to wetlands in India during the winter season when the temperatures fall in their home grounds.

Prayagraj (Uttar Pradesh) [India], October 4 : They make their way to various areas including Sangam, Bheerpur and Sirsi. They usually reach here in November and December when the cold increases. This year they are back early in the month of October. The wetlands are viewed as breeding grounds for these birds where they get a variety of food. Speaking to ANI, Mithilesh Nishad, a boatman said that the birds will bring more people here.
“Every year, after the arrival of these birds, a large number of people visit the ghats to watch them. These birds increase tourism and because of which we earn more. I am very thankful that these birds are back at the ghats,” said Nishad.
